Deriviative of Minoritary Actions – Russian Court Practice

Practically none of the issues arising in connection with indirect claims has found a uniform construction in court practice. The contents of the article once more confirm the thesis that current procedural laws need to be supplemented with provisions on indirect claims process. Any attempt to fit the indirect claim structure into the framework of the applicable Code of Arbitration Procedure and (or) Code of Civil Procedure are doomed to failure.
