AGP’s IP team defended the CAMPARI brand

Our IP team successfully defended the CAMPARI brand of our client against a Russian competitor manufacturing similar products under the registered trademark CANTARE D’AMORE. In the labelling of its product the Russian manufacturer used a mark similar to our client’s semi-figurative trademarks (labels).

In the legal proceedings at the IP court where we challenged the competitor’s trademark registration, our team successfully showed to the court that the Russian competitor’s purchase and further use of the trademark concerned were abusive. The IP court ordered to cancel the competitor’s trademark registration.

This court order has been a material input to the case law on the application of Article 10 of the RF Civil Code to disputes over invalidation of trademark registrations, as it contains a detailed analysis f criteria required to ascertain the abuse and proof thereof.
